Terms and Conditions
These Terms and Conditions are the agreement between True Money Company Limited (the “Company”) of the one part and Alipay+ service user (“Service User”) of the other part, for connecting the Service User’s TrueMoney Wallet account to Alipay+ (the “Service”) operated by Alipay Connect Pte. Ltd. (“Alipay”), for the purpose of being a payment channel for the price of goods and/or services of the sellers, the service providers or the payment dealer for the price of goods and/or services of the sellers or the service providers, connecting to the Service (collectively called as the “Shop(s)”). In this regard, the Service User agrees and accepts the following Terms and Conditions in using the Service.

1. Use of Service
1.1 The Service User must download and register for TrueMoney Wallet account (“Account”), including complete an identity verification process as specified by the Company prior to using the Service.
1.2 The Service User shall be able to connect the Account to the Service through 2 channels as follows:

1.2.1 TrueMoney Wallet application channel, by login on Menu “Account” choose “Connected Services” choose “Shop or Payment Receiving Agent connecting to Alipay Connect”; or
1.2.2 Shop’s electronic channel, such as websites, applications, etc.

1.3 Upon the Service User having successfully connected the Account to the Service, the Service User’ Account will appear as one of payment methods on the Shop’s electronic channel.
1.4 The Company reserves the right to provide the Service to the Service User possessing the active Account and having Thai nationality only.
1.5 The Service User acknowledges that, for the use of Account, if the Service User enter the wrong password consecutively for number of times more than those as specified by the Company, then, the Company shall automatically and immediately suspend the use of Service. The Service User shall be able to continue to use the Service upon notifying the Company of his/her intention requesting the Company for proceeding in accordance with the methods as specified by the Company.
1.6 In case the Service User wishes to disconnect the Account from the Service, then, the Service User shall be able to do so through Shop’s electronic channel.
1.7 The Service User agrees and allows the Company to deduct electronic money from the Service User’s Account (“Money”) in accordance with the amount in Thai Baht currency as appeared while the Service User is making the payment for the price of goods and/or services of the Shop through the Service channel.
1.8 The Service User acknowledges that the Company is merely a service provider for facilitating the payment for the price of goods and/or services in accordance with the Service User’s instruction. Thus, in case of any problem occurring to the goods and/or services, or the goods and/or services having any defect, or any dispute arising, in such circumstance, the Service User shall directly contact those Shops by his/her own. In this regard, in doing such transaction, the Service User has the obligations as follows:

1.8.1 To check that the amount of Money in the Account is sufficient for paying the price of goods and/or service, and to check that such transaction complies with the terms as specified by the Company;
1.8.2 In case the amount of Money in the Service User’s Account is insufficient for paying the price of goods and/or service, then, the Service User still has the obligation to pay for the arrear to the Shop;

In providing the payment receiving service for the price of goods and/or service, the Company is not involved in the contracts, requirements or the rights and obligations in which the Service User and the Shop have among each other. Thus, in case of any dispute arising from the provision of payment receiving service for the price of goods and/or services, whether payment of overdue debt, partly payment of debt, suspension of service provision or any other circumstances, then, the Service User shall be responsible and/or resolve the dispute by his/her own. The Company shall not be involved in any case.

1.9 In case the Service User has completely conducted any transaction in connection with the use of Service, the Service User accepts that such transaction cannot be cancelled, revoked, changed or amended. In this regard, the Company shall not be responsible for any damage arising from the transaction in any case.

2. Other Provisions
2.1 The Company shall not be responsible for any and all losses or damages, whether directly or indirectly, occurring to the data in mobile phone or the mobile phone or any other devices as the result of provision of the Service.
2.2 Alipay disclaims any warranty, whether explicit or implied, regarding the accuracy, tort, ability to provide the Service under the licenses, suitability for usage, free from defect, error, or Service continuality without interruption.
2.3 The Company shall not be responsible for any damage or loss occurring to Money in the Service User’s Account arising by which the Service User’s mobile phone or any other devices has been lost or stolen, or by which the Service User is deceived, or from any other force majeure, or due to malware or computer virus or electronic attack on the mobile phone or any other devices of the Service User using the Service.
2.4 The Service User warrants he/she shall neither use the Service in conducting any financial transaction for illegal purposes, whether gambling, prostitution, money laundering, nor exploit the Account in a manner as payment dealer or for conducting any form of business, including the action in a manner contrary to public order or good morals, infringement of intellectual property right of any other persons or the offence against any laws.
2.5 For any failure and/or delay, whether occurring from computer system, internet system, electronic devices, mobile phone network systems or any other systems related to the use of this Service and/or any other similar causes arising from force majeure, the Service User shall not bring such hindrance to claim for any damage from the Company.
2.6 The Service User agrees to use the Service under lawful purposes in accordance with these Terms and Conditions only, and agrees to be bound, and cooperate to strictly comply with the provisions of any law applicable to the performance in accordance with these Terms and Conditions, both existing currently and/or in the future.
2.7 The Service User warrants that the Service User shall not make damage to the Service, nor interfere the use of the Service by any other persons, nor attempt to enter the Service or the network connecting to the Service without authority, whether by way of hacking, stealing, copying or destroying the data or any other methods. In case of any damage occurring from the Service User’s action, or any claim made against the Company for any liability due to the use of Service by the Service User according to the purpose aforesaid, or due to any action related to the Service User’s use of the Service, then, the Company shall have the right to immediately suspend or terminate the use of Service, and claim for all damages from the Service User.
2.8 The Company reserves the right to suspend or terminate the Service User’s use of Service without prior notification to the Service User if the Company has the information or has found the illegal use of the Service User’s Account, infringement against third party, including the intellectual properties of third party, the use in a manner as payment dealer or conduction of any form of businesses for commercial purposes. Additionally, the Service User shall solely be responsible for all damages occurring.
2.9 The Service User may contact for enquiry regarding the use of Service and/or inform the problems of the Service at TrueMoney Customer Care throughout 24 hours via Live Chat on the application, or call 1240.

3. Personal Data
The Service User agrees and acknowledges that the Company may collect, use or disclose the personal data, including but not limiting to transaction data, of the Service User given to the Company and/or being in the Company’s possession and/or lawfully obtained or collected by the Company from any other sources or any other persons, for the purposes of provision of the Service and other actions related to the Service; for development and enhancement of the provision of the Service’s efficiency, for provision of assistance service, acceptance of the request, or contact and enquiry, including sending news and information, marketing activities, sales promotional programs or product proposal, which may possibly be favorable to the Service User. Additionally, the Service User acknowledges that the Company may send or transfer the Service User’s personal data to Alipay or Shops or any other juristic entities having duty of personal data processing, both within and outside Thailand, so that the Company will be able to provide the best Service to the Service User. 4. Language
The translation of these Terms and Conditions, whether in any language whatsoever, is for the Service User’s convenience only, without any intention to change these Terms and Conditions. In case of any discrepancy between Thai version and any other language versions, the Thai version shall prevail.
